Terms of Service

The Terms of Service ("Terms") are a legally binding agreement that governs the relationship between SUMMIT WIND, as defined below, and yourself ("you") and your use of SUMMIT WIND’s products and social games for the web, mobile, or any other applicable platforms and/or devices (the “Service”). Please read these terms and conditions carefully and fully understand them, especially the exclusion or limitation of liability clauses and the separate agreement to enable or use a particular Service. Restrictions and exclusions of liability may be highlighted in bold type. If you are under the age of 18, please read these terms with a legal guardian and pay special attention to parts that apply to minors.

BY ACCESSING OR USING SUMMIT WIND’S SERVICE AND ACCEPTING THESE TERMS, YOU AGREE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE SERVICE.

THE SERVICE IS STRICTLY FOR ENTERTAINMENT PURPOSES ONLY AND DOES NOT OFFER REAL MONEY GAMBLING OR AN OPPORTUNITY TO WIN REAL MONEY OR REAL WORLD PRIZES.

1. Definitions

1.1 These Terms: This text, Privacy Policy, Infraction Terms, the Game Rules, and any amendments thereto. These shall become an integral part of the terms upon their official publication.

1.2 Game Rules: User rules, player regulations, game announcements, and notices of the game as published and amended from time to time by SUMMIT WIND.

1.3 SUMMIT WIND Games Service Provider: Summit Wind Culture & Tech Co., Ltd., which provides SUMMIT WIND Games and its Service to you, referred to as "SUMMIT WIND" in these terms.

1.4 SUMMIT WIND Games: Games operated by SUMMIT WIND, including computer games, web games, mobile games, and other forms of games; SUMMIT WIND Games may be provided in the form of software, in which case, SUMMIT WIND Games also include the relevant software and related documentation.

1.5 SUMMIT WIND Games Service: Various online operation services related to the Games provided by SUMMIT WIND to you, referred to as "Service" in these terms.

1.6 You: Also referred to as "Player" or "User," a natural person authorized to use the Game and its Service.

1.7 Game Data: Various data recorded by the server during your use of the game, including game logs, security logs, and other data.

2. Modifications to Terms

2.1 SUMMIT WIND reserves the right to modify these terms as necessary, with a notice on the relevant page. You may review the latest version of the terms on the relevant page.

2.2 If you continue to use the Service after the terms have been modified, you will be deemed to have accepted the updated terms. If you do not accept the terms, you must stop using the Service.

3. Account Security

3.1 You are solely responsible for maintaining the confidentiality of your Login Information and for all uses of your Login Information, including purchases, whether or not authorized by you. Ensure that you "log off" or exit from your Account (if applicable) at the end of each session. If you become aware of or reasonably suspect any breach of security, including any loss, theft, or unauthorized disclosure of your Login Information or unauthorized access to your Account, you must immediately notify SUMMIT WIND and modify your Login Information if appropriate.

3.2 To improve the security level of the Service, SUMMIT WIND reserves the right to apply certain technologies to the Game but does not guarantee that these security measures will completely eliminate the risk of your Game Account being stolen or lost.

3.3 If SUMMIT WIND restricts, freezes, or terminates your account in accordance with relevant Rules, it may result in the deletion of your game data and related information under your game account, and the loss of your rights and interests, for which you will be solely responsible and SUMMIT WIND shall not be liable.

3.4 For the efficient use of server resources, if you do not use your account to log in to the game for an extended period, SUMMIT WIND reserves the right to delete game data and related information of your account when necessary with prior notice, for which SUMMIT WIND shall not be liable.

4. Data Collection and Use

4.1 You agree and authorize SUMMIT WIND to collect your User information. Such information includes the game data under your account and other information that you provide to SUMMIT WIND or information which SUMMIT WIND needs to collect for security, User experience optimization, and other reasons. The collection of your User information by SUMMIT WIND will comply with relevant laws and regulations.

4.2 To better provide you with the Service, SUMMIT WIND may submit your User information to its affiliated companies, and SUMMIT WIND has the right to organize, analyze, and utilize your User information on its own or through third parties.

4.3 SUMMIT WIND or its cooperating third parties may provide you with information about SUMMIT WIND activities, promotions, and other information through SMS, phone calls, emails, and other various means based on your User information.

4.4 SUMMIT WIND guarantees that it will not disclose or provide your personal information to any third party, except under the following circumstances:

With your permission before disclosing or providing the information;

Pursuant to law or policy;

Only by disclosing or providing your personal information to provide Service you have requested;

At the request of an official authority;

Pursuant to other terms of this Agreement.

5. License and Use of the Service

5.1 Subject to your compliance with these terms and all applicable laws and regulations, SUMMIT WIND grants you a personal, non-transferable, and non-exclusive license to use SUMMIT WIND Games Service for non-commercial purposes, including:

Receiving, downloading, installing, starting, upgrading, logging in, displaying, running, and/or recording the SUMMIT WIND Games.

Creating game characters, setting nicknames, checking game rules, personal data, and game results, creating game rooms, setting game parameters, buying and using game props, game equipment, and game coins, using chat and other social sharing functions.

Using one or more of the other features supported and permitted by the SUMMIT WIND Games.

5.2 You may not record or transmit the contents of SUMMIT WIND Games to others in any way without SUMMIT WIND's permission, including the use of any third-party software for online distribution.

5.3 To the extent that SUMMIT WIND Games is provided in software form, your use of SUMMIT WIND Games and the SUMMIT WIND Games Service shall also comply with the provisions of Section 6 of these terms regarding software licenses.

5.4 All other rights not expressly granted herein or elsewhere in these terms shall remain reserved by SUMMIT WIND, and you must obtain separate written permission from SUMMIT WIND to exercise such rights.

5.5 If SUMMIT WIND discovers or receives a report or complaint from another person that a User has violated these terms, SUMMIT WIND reserves the right to delete the relevant content at any time without notice, and depending on the circumstances of the offending game account, impose penalties including but not limited to warning, restricting or prohibiting the use of all or part of the game functions, and banning the game account until the problem is resolved, and announce the results of the processing.

5.6 SUMMIT WIND reserves the right to penalize any violation of relevant laws and regulations or these terms in its reasonable judgment, to take appropriate legal action against any User who violates the laws and regulations, and to store relevant information and report to relevant departments according to laws and regulations, and the User shall solely bear all legal responsibilities arising therefrom.

5.7 You shall be independently liable for any claims, demands, or losses caused by or arising out of your violation of these terms or the relevant terms, and you shall indemnify and hold harmless SUMMIT WIND from and against any losses incurred as a result.

5.8 The game props, items, and coins are part of the Service, and you hereby agree that you have the right to use them in accordance with these terms. Your purchase and use of these items should follow the rules of these terms and specific game rules; at the same time, the game props, game equipment, and game currency may be subject to a certain period of validity. If you do not use the game props, game equipment, and game currency within the specified period of validity, except for force majeure or reasons attributable to SUMMIT WIND, once the validity period expires, it will automatically expire.

5.9 To provide a fair and healthy game environment, you fully understand and agree that in the course of your use of the Service, SUMMIT WIND has the right to gain technical insight into the random storage memory of your terminal device and related programs running in conjunction with the SUMMIT WIND Games. If any unauthorized program is discovered that may jeopardize the normal operation of the Service, SUMMIT WIND will collect all relevant information and take reasonable measures to combat such action.

5.10 You fully understand and agree that SUMMIT WIND reserves the right to periodically transfer or purge some of the past game data stored on SUMMIT WIND's servers to maintain the speed of the game for you and other Users.

5.11 In accordance with relevant laws and regulations and the provisions of these terms, SUMMIT WIND will take effective measures to protect the legitimate rights and interests of minors when using the Service, including the possibility of taking technical measures, prohibiting minors from contacting inappropriate games or game functions, limiting the playing time of minors, and preventing minors from becoming addicted to the Internet. As part of the game rules, SUMMIT WIND will also publish guidelines and warnings for SUMMIT WIND Game Users at appropriate places in games, including descriptions of the game content, the correct use of the game, and ways to prevent harm from occurring. All minor Users should carefully read and comply with these guidelines and instructions under the guidance of legal guardians; other players should avoid publishing or generating any content harmful to the physical and mental health of minors in the process of using the Service, and work together to create a healthy gaming environment.

6. Software Licenses

6.1 The use of the Service may require the downloading and installation of software, which you may obtain directly from the relevant SUMMIT WIND website or from a third party authorized platform. If you obtain a game with the same name as SUMMIT WIND Game from a third party that is not authorized by SUMMIT WIND, you will be deemed not to be authorized by SUMMIT WIND and SUMMIT WIND cannot guarantee that the game will work properly and will not be liable for any damages you may suffer as a result.

6.2 SUMMIT WIND may have developed different software versions for different terminal devices or operating systems, including but not limited to Windows, iOS, Android, Windows Phone, Symbian, Blackberry, and others. You should download the appropriate version according to your device. After downloading it, you need to follow the steps prompted by the program to install it properly.

6.3 If the SUMMIT WIND Game is provided in software form, SUMMIT WIND grants you a personal, non-transferable, and non-exclusive license to download, install, log in, and use the SUMMIT WIND Game on a single terminal device for non-commercial purposes only.

6.4 To provide a better and safer Service, you may be recommended to install additional software during the installation of the Software, which you may choose to install or not install.

6.5 If you no longer need the software or need to install a new version, you can uninstall it by yourself. If you would like to help SUMMIT WIND improve our products and Service, please tell us the reason for uninstalling.

6.6 To ensure the security and functional consistency of the Service, SUMMIT WIND reserves the right to update the Software, or to change or limit the effectiveness of certain features of the Software, without specific notice.

6.7 Older versions of the Software may not be available after the release of a new version of the Software. SUMMIT WIND does not guarantee the continued availability of older versions of the Software and the corresponding customer Service, so please always check and download the latest version.

7. User Responsibilities and Code of Conduct

7.1 You are responsible for all actions taken under your game account, including any content posted by you and any consequences thereof. You shall make your own judgments regarding the content of SUMMIT WIND Games and assume all risks arising from the use of Service, including any reliance on the accuracy, completeness, or usefulness of the content of SUMMIT WIND Games. SUMMIT WIND cannot and will not be liable for any loss or damage arising out of the foregoing risks.

7.2 You may not do anything that infringes the intellectual property rights of SUMMIT WIND Games, or do anything else that is detrimental to the legal rights of SUMMIT WIND Games or other third parties, except that you may use the Service in accordance with these terms.

7.3 Except as permitted by law or as permitted in writing by SUMMIT WIND, you may not do any of the following:

Removal of copyright information on game software and copies thereof.

Reverse engineering, disassembling, decompiling, or otherwise attempting to discover the source code of the game software.

Scanning, probing, and testing of game software to detect, find, and locate any bugs or weaknesses that may exist in it.

Copying, modifying, adding, deleting, mounting, or creating any derivative works on the game software or the data released into any terminal's memory during the running of the software, the client-server interaction data during the running of the software, and the system data necessary for the running of the software, in the form of, but not limited to, using plug-ins, plug-ins or third-party tools/Service that are not legally authorized to access the software and related systems.

Modifying or falsifying instructions or data in the operation of the software, adding, deleting, or altering the functions or operational effects of the software, or publishing such methods, regardless of whether such acts are for commercial purposes.

Using third-party software, plug-ins, plug-ins, or systems not developed or authorized by SUMMIT WIND to use SUMMIT WIND Games and Service, or producing, publishing, distributing such tools.

Using, renting, lending, copying, modifying, linking, reproducing, compiling, publishing, creating mirror sites, etc., of content for which the game has intellectual property rights.

Establishing mirror sites of SUMMIT WIND Games, or taking snapshots of web pages (networks), or providing others with Service identical or similar to the SUMMIT WIND Games Service by means of setting up servers.

Isolating any part of the SUMMIT WIND Games for separate use, or making any other use that is inconsistent with these terms.

Using the name, trademark, or other intellectual property of SUMMIT WIND Games.

Other acts that are not expressly authorized by SUMMIT WIND.

Actions that imply or falsely claim to be an internal employee of SUMMIT WIND or some special identity in an attempt to gain an improper advantage or affect the rights of other Users.

Using illegal or inappropriate words, characters, etc., including for character naming, in the game of SUMMIT WIND.

Disrupting the game of SUMMIT WIND or interfering with the proper conduct of the SUMMIT WIND Service.

Engaging in illegal externalities.

Disseminating unlawful statements or inappropriate information.

Stealing another person's game account or game item.

Engaging in private trading of game accounts.

Trading game items, game equipment, game currency, etc., privately.

Other misconduct widely recognized in the industry, whether or not it has been expressly set forth in these terms or the Rules of the Game.

Creating multiple accounts to farm coins.

Exploiting game bugs for excessive gains.

Uploading inappropriate images or avatars.

7.4 If you do any of the following acts in the course of using SUMMIT WIND Games Service, SUMMIT WIND will, depending on the seriousness of the situation, temporarily or permanently prohibit you from logging in, delete your game account and game data, delete relevant information, and take other measures in accordance with these terms and the relevant game rules. If the situation is serious, SUMMIT WIND will hand over the matter to the relevant administrative organs for administrative punishment, or pursue your criminal liability.

8. Disclaimers and Limitation of Liability

8.1 The Service is provided to you on an "AS IS" basis. SUMMIT WIND DOES NOT GUARANTEE THAT THE SERVICE WILL BE ERROR-FREE AND UNINTERRUPTED, THAT ALL DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE WILL BE UNINTERRUPTED BY VIRUSES OR ANY OTHER DAMAGES. Except as expressly provided by law, SUMMIT WIND hereby expressly disclaims all warranties of any kind, express or implied, including, but not limited to, warranties of performance, fitness for a particular purpose, or non-infringement, with respect to the Service.

8.2 In no event shall SUMMIT WIND be liable for any loss you may suffer in connection with your use of the Service as a result of force majeure. Such force majeure events include, but are not limited to, national laws, regulations, policies, and orders of state authorities or other unpredictable, unavoidable, and insurmountable events such as earthquakes, floods, snowstorms, fires, tsunamis, typhoons, strikes, wars, and the like.

8.3 SUMMIT WIND may independently decide to change, terminate, or suspend your use of any of the Service at any time without prior notice to you, except if you need prior notice in accordance with laws and regulations or the agreement between you and SUMMIT WIND. If SUMMIT WIND terminates or suspends your use of any of the Service in accordance with the relevant provisions of the laws and regulations or these terms, SUMMIT WIND shall not be liable to you and shall have the right to hold you liable for such termination or suspension.

8.4 SUMMIT WIND Games may cause your game characters, game items, game equipment, and game currency account data to be unusual due to game software bugs, version update defects, third-party virus attacks, or any other factors. If the abnormal data is found to be unusual behavior, SUMMIT WIND reserves the right to restore your account data to its original state before the abnormality occurs (including recovering the transferred data from a third party), and SUMMIT WIND is not required to bear any responsibility to you.

8.5 SUMMIT WIND does not authorize you to obtain game accounts, game props, game equipment, game coins, etc., from any third party through purchase, gift, or other means, and SUMMIT WIND is not responsible for third-party transactions and does not accept any complaints arising from any disputes arising from any third-party transactions.

8.6 You fully understand that the advertisements, links, or other forms of promotional content put by third parties in the game are provided by them, and you should judge their authenticity by yourself. SUMMIT WIND does not make any express or implied guarantee for their promotional content.

8.7 You fully understand that there is an objective situation of non-interoperability between different operating systems, which is not caused by SUMMIT WIND, and may result in your top-ups and game data in one operating system cannot be smoothly transferred to another operating system. The risk of loss of top-ups and game data due to switching between different operating systems shall be borne by you, and SUMMIT WIND shall not be held liable for any loss of top-ups or game data caused by such switching.

8.8 You fully understand that SUMMIT WIND may set up areas or play rules that require you to play against each other, and if you do not agree to play against each other, please do not enter such areas; if you do, you will be deemed to have agreed to such play rules and accept the consequences.

9. Intellectual Property Rights

9.1 SUMMIT WIND is the owner of all intellectual property rights in SUMMIT WIND Games. All copyrights, trademarks, patents, trade secrets, and other intellectual property rights of the game and all information content related to the game (including text, pictures, audio, video, graphics, interface design, layout frames, relevant data, or electronic documents) are protected by the laws and regulations of the People's Republic of China and the corresponding international treaties. SUMMIT WIND enjoys the above intellectual property rights, except for the relevant rights holders in accordance with the law.

9.2 The title to and intellectual property rights in the Game Data arising from your use of the SUMMIT WIND Games Service shall remain with SUMMIT WIND, and SUMMIT WIND shall have the right to dispose of such Game Data.

9.3 The Game may involve the intellectual property rights of third parties, and if such third parties have a requirement for you to use such intellectual property rights in the Game based on these terms, SUMMIT WIND will inform you of such requirement in an appropriate manner, and you shall comply with such requirement as well.

10. Compliance and Governing Law

10.1 You shall comply with local laws and regulations and respect local morals and customs when using the Service. If your behavior violates local laws and regulations or morals, you shall be independently responsible for such behavior.

10.2 You shall avoid involving SUMMIT WIND in political and public events by using the Service, otherwise SUMMIT WIND has the right to suspend or terminate the Service to you.

Protection of personal information and privacy is one of SUMMIT WIND's basic principles. Unless otherwise stipulated in these terms, SUMMIT WIND Games Service will follow the relevant privacy policy published by SUMMIT WIND.
